Advance Rate

The discount applied to a collateral pool's stated value to determine how much capital a lender will advance against it. In legal-asset lending, the advance rate should be applied against a stated percentile of the collateral's distribution rather than against its mean or a point estimate.

The advance rate is the mechanism that converts a stated collateral value into an actual capital commitment, and in legal-asset lending its construction matters as much as its size. Applying an advance rate against the mean of a settlement or award distribution with a meaningful right tail systematically overstates the collateral's reliably realizable value, because the mean is pulled upward by outcomes the lender should not be counting on to cover its advance. A properly constructed advance rate is applied against a conservative, disclosed percentile of the distribution instead, giving the lender a defensible floor rather than an optimistic average, and the percentile chosen should be stated explicitly in the facility's governing documents rather than left as an internal, undisclosed convention. The advance rate should also vary by the depth of the comparable population behind a given matter's distribution: a narrow band supported by a deep comparable population justifies a different advance rate than a wide band reflecting genuine uncertainty in a thinly precedented matter, even where the two matters share a similar headline expected value. Institutions negotiating a facility should ask specifically which percentile the advance rate is pegged to and how that percentile was chosen, because an advance rate quoted without that context is a number without the context needed to evaluate whether it is actually conservative.
