ATE (After-the-Event Insurance)

A policy taken out after a dispute has arisen to cover a claimant's adverse costs exposure if the matter is lost. ATE increasingly wraps litigation finance positions directly, requiring the insurer to price the same underlying litigation outcome risk the funder is also pricing.

After-the-event insurance, commonly abbreviated ATE, is a policy purchased after a dispute has already arisen, typically covering a claimant's exposure to an adverse costs order if the matter does not succeed. ATE is one of the clearest points of convergence between insurance and litigation finance, because an ATE insurer pricing a policy attached to a funded position is pricing exposure to the same underlying litigation outcome the funder beneath it is also pricing, using outcome-probability methods that increasingly resemble the methods litigation funders themselves apply. Structures where ATE insurance wraps a litigation finance position directly are becoming more common, and they work best when the insurer and the funder price against the same underlying distribution rather than two separate, reconciled estimates built on different data. This convergence carries a governance requirement worth stating plainly: insurance and litigation finance operate under different regulatory postures and different disclosure obligations depending on jurisdiction, and a converged, ATE-wrapped structure has to satisfy both sets of obligations simultaneously, rather than assuming either industry's existing compliance framework automatically extends to cover the combined product, an assumption that leaves the structure resolved on the intelligence side and unresolved on the compliance side until an examiner or a regulator eventually asks the question directly.
