Collection Risk

The risk that a judgment, though legally valid, cannot actually be collected because a defendant lacks the capacity or willingness to pay. Collection risk is priced from defendant-specific asset and payment data, a different data set and discipline than pre-judgment outcome-probability modeling.

Collection risk is the second of the two residual risks that dominate a judgment's pricing once trial-level merits uncertainty has resolved, alongside appellate risk: even a judgment that survives appeal intact has value only to the extent it can actually be collected from the defendant, which depends on that defendant's asset position, payment history, and behavior around judgment-proofing, moving or restructuring assets specifically to frustrate collection. Pricing collection risk requires asset tracing capability and ongoing monitoring of a defendant's financial condition after judgment, a genuinely different skill and data set than the outcome-probability modeling used before judgment, and an institution that is excellent at pre-judgment underwriting is not automatically equipped to price collection risk well. A judgment against a well-capitalized, historically compliant defendant carries a meaningfully different collection-risk profile than a judgment of identical face value against a defendant of uncertain solvency, and a pricing model that treats both the same because their face values match has not actually priced the asset's real risk, only its stated size at the moment of judgment. Collection risk should be re-assessed on a defined cadence for as long as a judgment remains uncollected, since a defendant's financial position can deteriorate materially over a period a static, one-time assessment would never catch.
