Litigation Management

← All Terms

Litigation management is the insurer's or a company's control of its legal matters, including counsel selection, budgets, strategy and settlement decisions. Done well, it reduces both cost and the time claims stay open.

Defense spending and outcomes depend on early decisions: which matters to settle, which to try and which counsel to use. Measurement helps by placing each matter against comparable resolved matters in the same forum and by flagging those that are drifting past their expected duration.

A portfolio view matters. A company with thousands of open matters needs triage rules, budget tracking and a way to see the whole book, not only the files that arrive on the desk.

Litigation management is not the replacement of counsel. It is the discipline that surrounds counsel's work.
