Remittitur

← All Terms

Remittitur is a court's reduction of a jury's damages award that it finds excessive, usually offered to the plaintiff as an alternative to a new trial. It lowers the realizable amount of a verdict.

Large verdicts are often cut after trial, by remittitur, by statutory caps or on appeal. A funder valuing a verdict has to account for the distribution of reductions, not only the headline award.

The treatment of excessive awards differs by jurisdiction, and some rules limit how much a court can adjust.

Remittitur is not a reversal. The verdict on liability stands, and the amount is adjusted.
