Monitorship

← All Terms

A monitorship is an arrangement in which an independent person reviews a company's compliance for a set period as a term of a resolution with an authority. It extends the effect of an enforcement action over time.

The monitor reports to the authority on whether the company is meeting its obligations. The cost is borne by the company and the period commonly runs for years.

A monitorship affects the duration of the matter's consequences and the company's operations, and it is a factor in assessing counterparty risk.

A monitorship is not a punishment in itself. It is a mechanism to verify that required changes are made.
