Stay of Proceedings

← All Terms

A stay of proceedings is a court order that pauses all or part of a case or the enforcement of a judgment, usually for a defined period or until a condition occurs. It extends duration without resolving anything.

Stays are granted pending appeal, while related proceedings conclude, during bankruptcy or while a higher court decides a controlling question. They can freeze collection on a won judgment.

A debtor who wants a stay pending appeal may be required to post a bond, which is both protection for the judgment holder and a measure of the debtor's access to resources.

A stay is not a dismissal and not a loss. It changes timing, and timing is a first-order driver of return.
