Summary Judgment

← All Terms

Summary judgment is a ruling by the court, without a trial, that there is no genuine dispute of material fact and one party is entitled to judgment as a matter of law. It is a principal way cases end before trial.

The motion is usually made after discovery. If granted in full, it resolves the case. If granted in part, it narrows the issues. If denied, the case moves toward trial, and settlement pressure typically increases.

For measurement, the stage matters because the cohort changes. Matters that have survived summary judgment have a different remaining distribution of outcomes and time than those that have just been filed.

Summary judgment is not a finding that a party is right on every fact. It is a determination that a trial is unnecessary on the issues decided.
