Prejudgment Interest

← All Terms

Prejudgment interest is interest awarded on a recovery for the period between the loss, or the filing, and the judgment. It compensates for the time value of money and varies widely by jurisdiction and claim type.

Whether it is available, the rate and the starting date are set by statute or case law. In some forums it is automatic and in others discretionary or unavailable.

It can add materially to a long-running commercial judgment and shifts the economics of duration, since each additional month adds to the award while also delaying its receipt.

Prejudgment interest is not the same as post-judgment interest, which accrues after judgment is entered until it is paid.
